  1. Introduction and Mission Statement

The Referral Company, LLC is a “Limited Function Referral Company Licensed in the State of Idaho.  Our Goal is to provide Affordable solutions to agents interested in maintaining earning potential through Referrals within the Real-estate industry.

A Referral being defined as Sharing in a commission created by a lead provided to a Licensed & Active agent that results in the purchase or sale of real-estate resulting in a commission.

 

  1. Primary Duties of the Referral Members

Members shall maintain an active Real-Estate License. Member shall not engage in advertising for sale any real-estate.  Member shall not advertise for or take any listings for property for sale.  Member shall only use approved referral form provided to the member by the Company.  Members are not to engage in any aspects of the real-estate industry as overseen by the applicable real-estate commission, other than collection of referral commissions.  Members take all liability for any or all confidentiality agreements entered into by the Member.  Member to maintain in good standing all fees owed to the Company.  Any changes to the Member license status to be reported immediately.  It is the Members responsibility to execute properly the referral contract. .  In the case of a disputed referral it is the member’s responsibility to prove the Members right to said referral fee, and to collect said referral fee.
      

  1. Primary Duties of the Referral Company

The Company shall provide an Active Broker License in the applicable state where the agent is domiciled.  Company shall provide referral contracts for use by Members.  Company shall accept referral fees from transaction closings as authorized by the applicable real-estate commission on behalf of members in good standing.  Company shall pay out within five (5) business days the full value of the appropriate percentage owed to the agent for that transaction, unless otherwise determined by the Company and the Member.  Company shall provide 1099 tax documentation at the end of the calendar year. The Company will keep a full accounting of referrals paid, pending, and outstanding.
